Terms and conditions
These terms set out how you buy from SmartaView, what you can expect from us, and what we ask of you. Please read them before placing an order.

A note on consumer rights
Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015 or other applicable law. Where any term conflicts with your statutory rights, your statutory rights prevail.
1. About us and these terms
This website is operated by SmartaView Ltd (company number 16581949), a company registered in England and Wales whose registered office is at 128 City Road, London, EC1V 2NX. In these terms "we", "us" and "our" refer to SmartaView, and "you" and "your" refer to the person placing an order.
These terms apply to every order you place through the website. By placing an order you confirm that you accept them. We may update these terms from time to time, and the version that applies to your order is the one published on the website when you place it.
2. Definitions
A few terms are used throughout. "Products" means the made-to-measure aluminium glazing and related items we supply. "Order" means your request to buy Products through the website. "Configuration" means the size, finish, glass and other options you select for a Product. "Structural opening" means the finished aperture into which a Product is designed to fit, as explained in our measuring guide.
3. Your account
You can browse and configure Products without an account, but you will need to provide accurate contact and delivery details to complete an order. If you create an account, you are responsible for keeping your login details secure and for any activity carried out under your account. Please let us know promptly if you believe your account has been used without your permission.
4. Placing an order
When you configure a Product, the website shows a live price based on the options you choose. Submitting an order and payment is an offer by you to buy the Products in your basket. Your order is accepted, and a contract is formed between us, only when we send you an order confirmation by email.
If we are unable to accept your order, for example because a Product is unavailable, because of an error in the price or description, or because we cannot verify your details, we will tell you and will not charge you. If you have already paid, we will refund you in full.
Because every Product is made to your Configuration, please check your order confirmation carefully as soon as you receive it. Tell us straight away if anything looks wrong, as we may be unable to change an order once manufacturing has begun.
5. Made-to-measure products and your measurements
Our Products are manufactured to the sizes and specification you provide. The accuracy of your measurements is your responsibility. We recommend you follow our measuring guide and, given that we supply only, that you have your sizes confirmed by a competent person before you order.
We cannot accept responsibility for Products that do not fit because the measurements supplied were incorrect, or because the structural opening changed after measuring. If you are unsure, please contact us before placing your order and we will do our best to help.
6. Price and payment
Prices are shown in pounds sterling and include VAT at the applicable rate unless stated otherwise. The price you pay is the price displayed in your basket at the point you place your order. Delivery is free to UK mainland addresses on all orders, with no minimum order value.
We take care to price every Product accurately, but errors can occur. If we discover that a Product has been priced incorrectly, we will contact you before accepting your order and give you the choice of continuing at the correct price or cancelling.
Payment is taken securely at checkout. We accept the major payment methods shown at checkout. You confirm that you are authorised to use the payment method you choose.
7. Delivery
We offer free delivery to UK mainland addresses on all orders. Estimated lead times are shown during configuration and confirmed on your order confirmation. Lead times are estimates and are not guaranteed, as manufacturing times can vary.
Deliveries are typically made to the kerbside, and someone aged 18 or over should be available to receive and check the goods. Please inspect your delivery on arrival and note any visible damage or shortage with the carrier and report it to us as set out below. Risk in the Products passes to you on delivery.
Please do not book any third-party services or arrange fitting until your Products have arrived and you have checked them, as we cannot be responsible for costs incurred before delivery and inspection.
8. Supply only: installation and building regulations
SmartaView is a supply-only business. We do not provide an installation, fitting or surveying service, and our price covers the supply of Products only. Fitting your Products, and any associated work such as building the kerb for a rooflight or lantern, is your responsibility.
You are responsible for ensuring that any installation is carried out competently and that all relevant building regulations, planning requirements and other legal obligations are met. We are not responsible for the installation of our Products or for any issue arising from how they are fitted.
9. Your right to cancel
Most of our Products are made to your specification or clearly personalised. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day right to cancel does not apply to goods that are made to your measurements or personalised, once we have begun making them.
This does not affect your right to cancel a non-bespoke item that has not been personalised, or your rights if a Product is faulty, damaged or not as described. If you wish to cancel and are unsure whether your order qualifies, please contact us as early as possible and we will tell you where you stand.
10. Faulty, damaged or incorrect goods
If a Product arrives damaged, is faulty, or is not what you ordered, please contact us within a reasonable time of delivery, ideally within 48 hours to confirm for visible transit damage, with photographs where possible. We will work with you to put things right by repair, replacement or refund in line with your statutory rights under the Consumer Rights Act 2015.
Please keep any damaged packaging and the Product itself until the issue is resolved, as we may need to inspect them or arrange collection.
11. Guarantee
Our Products come with a manufacturer's guarantee of up to 20 years. The exact length and cover vary by Product and by the manufacturer who makes it, and the applicable guarantee is set out on the relevant product page and in your documentation.
Guarantees generally cover defects in materials and manufacture under normal domestic use, and typically do not cover damage caused by incorrect installation, misuse, accidental damage, or failure to maintain the Product as advised. A guarantee is in addition to, and does not replace, your statutory rights.
12. Product information, colours and finishes
We aim to describe and illustrate our Products as accurately as possible. Images, swatches and on-screen colours are intended as a guide, and the appearance of finishes can vary depending on your screen and lighting. If an exact colour match matters to you, please request a sample or contact us before ordering.
Aluminium is a natural material and slight variations in finish are normal and are not considered defects.
13. Our liability to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for losses that are not foreseeable or for losses arising from how Products are installed, which is outside our control.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for any matter where the law does not allow exclusion.
14. Events outside our control
We are not liable for delays or failures caused by events outside our reasonable control, such as supply shortages, manufacturing disruption, extreme weather or carrier delays. If such an event affects your order, we will let you know and work with you to minimise the impact. If the delay is substantial, you may contact us to cancel any affected Products that have not yet been made and receive a refund for them.
15. Your personal information
We use your personal information only as set out in our Privacy Policy, which explains what we collect, how we use it and your rights. By placing an order you confirm that the details you provide are accurate and that you are happy for us to use them to fulfil your order.
16. Complaints and dispute resolution
If something is not right, please contact us first so we can try to resolve it quickly. We aim to acknowledge complaints promptly and to keep you updated until they are resolved.
If we cannot resolve a complaint to your satisfaction, you may be able to use an alternative dispute resolution scheme. Details of any scheme we participate in are available on request.
17. Other important terms
If any part of these terms is found to be unenforceable, the rest will continue to apply. If we do not insist that you perform any of your obligations, or we delay in enforcing our rights, that does not mean we have waived them. We may transfer our rights and obligations under these terms to another organisation, and we will always tell you if this happens. You may not transfer your rights or obligations without our agreement.
18. Governing law
These terms are governed by the law of England and Wales, and any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
